ORDINANCE NO. 0-2023-0010 AN ORDINANCE OF THE OREM CITY COUNCIL AMENDING A PORTION OF SECTION 12-9-6 (LICENSE FEE) OF THE OREM CITY CODE PERTAINING TO RENTAL DWELLING LICENSE FEES FOR ACCESSORY DWELLING UNITS WHEREAS Section 12-9-6 of the Orem City Code establishes rental dwelling license fees for rental dwellings in the City; and WHEREAS Section 12-9-6 requires a rental dwelling license fee both for the initial license application and for annual renewal of the license; and WHEREAS the City Code allows accessory dwelling units to be built and maintained within single-family dwellings that are owner-occupied; and WHEREAS the City currently has several hundred licensed accessory dwelling units; and WHEREAS accessory dwelling units are often occupied by the children, parents or other relatives of the owner of the house who lives in the primary dwelling and often pay no rent to the owner of the house; and WHEREAS because the primary dwelling in a house with an accessory dwelling unit is required to be owner-occupied, it is reasonable that such owner be exempted from paying the annual rental dwelling license renewal fee; and WHEREAS the City Council desires to exempt the owners of dwellings containing a legal accessory dwelling unit from the requirement to pay an annual rental dwelling license renewal fee; and WHEREAS the City Council held a public meeting on May 16, 2023, to consider the proposed amendment to Section 12-9-6 of the Orem City Code that would exempt homes with an accessory dwelling unit from the annual rental dwelling license renewal fee; and WHEREAS the matter having been submitted and the City Council having fully considered the request as it relates to the health, safety, and general welfare of the City; the orderly development of land in the City, the effect upon neighborhoods, and the special conditions applicable to the request. NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OREM, UTAH, as follows: 1. The City Council finds that the request to amend Section 12-9-6 is reasonable and in the best interest of the City because the primary dwelling in houses with accessory dwelling units are owner-occupied (in contrast to most rental dwelling units) and the accessory dwelling units are frequently occupied by relatives of the owner who often pay no rent to the owner. 2. The City Council hereby amends Section 12-9-6 of the Orem City Code to read as shown in Exhibit "A" which is attached hereto and is incorporated herein by reference. 3. If any part of this ordinance shall be declared invalid, such decision shall not affect the validity of the remainder of this resolution. 5. This ordinance shall take effect July 1, 2023.
